THIS WEEK'S DAVENING INSTRUCTIONS FOR THOSE WITHOUT A MINYAN FRIDAY NIGHT: Kabbalat Shabbat as regular. Remember that following the Maariv amida we say va’yichulu, but then skip to aleinu (i.e. no magen avot). SHABBAT DAY: We do not recite Yikum Purkan. We recite the Birkat HaChodesh for Rosh Chodesh Tammuz (Monday and Tuesday). Av haRachamim is not recited. TORAH READING: Parshat Shelach and the Haftarah is Joshua 2:1- 24. Chapter 3 of Pirkei Avot is read. SUNDAY: We do not say tachanun at mincha, because it is erev Rosh Chodesh. During the amida of maariv we insert yaale v’yavo (if someone forgot, this at maariv it is not necessary to repeat the amida). MONDAY - ROSH CHODESH TAMMUZ: Recite the usual services for Rosh Chodesh, yaale v’yavo in the amida, half-Hallel followed by the shir shel yom and borchi nafshi. We do not recite tachanun or lamnatzeach. Following u’va l’tzion, remove tefillin and then recite musaf for Rosh Chodesh. No tachanun at mincha, and yaale v’yavo in the amida. HALACHA OF THE WEEK: Taking Off Your Tefillin before Musaf of Rosh Chodesh On Rosh Chodesh, our custom is to remove our tefillin before reciting musaf. One reason for this is because, in the kedusha that is recited during musaf by those who daven Nusach Sefard, it opens with the words, "keter yitnu Lecha" [You (G-d) will be given a crown]. Since we are crowning G-d, it would be inappropriate for us to be wearing our tefillin, which are also referred to as our crown [Mishna Berura 25:61].
But what about those who daven Nusach Ashkenaz and do not say those words in kedusha? In that case, we remove our tefillin, to remind us that Rosh Chodesh is as a sort of holiday, and just as we do not wear tefillin on holidays, we don't wear them for the musaf of this day [Mishna Berura 423:10]. For this reason, some even remove their tefillin before Torah reading because of its unique nature [Levush Orech Chaim 423:4] and others who remove their tefillin before Hallel [Rema mi'Fano 108].
Nevertheless, the prevalent custom is to wait until musaf to remove our tefillin. But what is before musaf? Most authorities say that the tefillin are removed after the kaddish, preceding musaf [Magen Avraham Orech Chaim 25:30]. It is for this reason that people will leave their tefillin unwrapped, to avoid an unnecessary interruption between the kaddish and musaf [Mishna Berura 25:59]. (Wrapping the tefillin during the repetition of musaf is not appropriate since we are required to listen to the repetition and not engage in any other things [Mishna Berura 124:17; Igrot Moshe, OC 4:19; Tzitz Eliezer 11:10].
However, other sources indicate that the tefillin should be removed after completing before the kaddish is recited [Siddur Baal HaTanya], allowing the wearer to wrap up his tefillin and not create a delay between kaddish and musaf. This was the practice of Rav Joseph B. Soloveitchik [Nefesh Harav, p. 116] and Rav Yosef Chaim Sonnenfeld [Piskei Teshuvot 28, n. 29].
One who forgot to remove his tefillin before musaf should continue davening, because removing tefillin is only a custom while interrupting one's musaf is forbidden [Revivot Ephraim 8:13].
DVAR TORAH Following the sin of the Spies, G-d decreed, "You shall bear your punishment for forty years, corresponding to the number of days—forty days—that you scouted the land: a year for each day. Thus, you shall know what it means to thwart Me." [Bamidbar 14:34].
Why did G-d punish the Jews with 40 years of wandering and not just one year? After all, the actual sin of the spies occurred on only one day - when they delivered their terrible report?
The answer, wrote HaRav Asher Weiss, is based on the understanding that the sin of lashon harah is not a sin only of the mouth. It is also a sin of the eyes — a sin in how one perceives things. Two people can see the same thing and yet, view it in totally different ways.
Therefore, the reason the punishment was forty years for forty days was because for forty days the Spies looked askance at the Land of Israel. As the Rabbis taught, when they saw funerals occurring every day ("a Land that devours its inhabitants") they refused to see this as they way G-d protected them during their mission, and instead as proof that the land was inhospitable.
According to HaRav Weiss, while their report took place on just a single day, it was preceded by 39 days of jaundiced views, and an absence of faith in G-d. As a result, our punishment was not for one day, but the entire duration of the mission.
